A federal judge just told the president he cannot ban reporters he does not like from the White House. And the judge was appointed by Trump himself.
On Tuesday, U.S. District Judge Tim Kelly granted a preliminary injunction blocking the Trump administration from keeping CNN, MS NOW, and Politico reporters off White House grounds. The judge found the ban likely violates the First Amendment.
Major Takeaways
A federal judge blocked Trump’s ban on CNN, MS NOW, and Politico reporters, finding it likely violates the First Amendment.
The judge ruled Trump’s own comments proved the ban was retaliation for negative coverage, not national security.
Judge Tim Kelly was appointed by Trump in his first term, making this ruling a blow from his own pick.
Trump’s Own Words Sank His Case
Here is the part the White House cannot spin. Judge Kelly pointed directly at Trump’s own comments to prove the ban was unconstitutional.
The judge wrote there was a “likely causal link” between the outlets’ protected speech and Trump revoking their press passes. In plain terms, Trump banned them because he did not like what they wrote.
“President Trump likely banned Plaintiffs from the White House because he believes that their reporting is generally inaccurate and biased against him,” Kelly wrote.
The Justice Department tried to argue national security motivated the ban. Kelly shut that down completely. He wrote there was “no evidence in the record” that national security was the reason, noting Trump himself never once said national security was behind the decision.
When your own words prove you violated the Constitution, no lawyer can save you.
Why This Matters for Black America
Some folks might hear “CNN and Politico” and think this does not touch us. That would be a mistake.
The Black press has been fighting this exact battle for over a century. When Frederick Douglass published the North Star, when Ida B. Wells reported on lynching, when the Chicago Defender told the truth about the South, the powerful tried to silence them.
The principle is the same today. If a president can ban CNN for negative coverage, he can ban anyone. Today it is cable news. Tomorrow it could be the Black outlets holding power accountable in our communities.
Press freedom is not a luxury for us. It is survival. When the government decides which journalists get access based on whether they smile at the president, every community that depends on truthful reporting is at risk.
And let us be honest about who gets silenced first when press freedom erodes. It is never the powerful. It is the outlets covering police violence, voter suppression, and the stories mainstream media ignores.
The Timeline
Trump announced the ban on September 18, declaring he was “banning” the three outlets from the White House. Legal experts immediately called it unconstitutional.
The outlets sued on September 21, arguing the ban violated the First and Fifth Amendments. Judge Kelly quickly issued a temporary restraining order forcing the White House to let reporters back in.
But the White House kept finding ways to retaliate. Politico was blocked from Air Force One. Other outlets refused to take their place in solidarity.
Kelly’s temporary order was set to expire Tuesday. His new preliminary injunction extends the protection while the full lawsuit plays out. The administration is expected to appeal.
A Judge Trump Picked
Here is the detail that stings the most for the White House. Judge Timothy Kelly was appointed to the federal bench by Donald Trump during his first term.
This is not a liberal activist judge. This is Trump’s own pick telling him the Constitution does not bend for presidential grudges.
Kelly had already ruled in an earlier phase that the White House violated due process by revoking press badges without fair notice. Now he has gone further, finding the ban itself likely violates the First Amendment’s protection against viewpoint discrimination.
Viewpoint discrimination. That is the legal term for what happened here. The government cannot punish you for disagreeing with it. That is the whole point of the First Amendment.
What Comes Next
The Trump administration will almost certainly appeal. The Justice Department has already signaled it wants to overturn decades of precedent on White House press access.
But for now, the reporters are back in the building. The cameras are rolling. The questions are being asked.
And that matters. Because a free press is not about protecting CNN. It is about protecting your right to know what your government is doing in your name.
When the powerful can choose their coverage, the truth becomes optional. Judge Kelly just reminded everyone that the Constitution does not work that way.
